Workers' compensation is a system whereby benefits are provided to employees suffering an injury or occupational illness in the workplace. Unless exempted, all employers with one or more employees are required to carry workers' comp insurance obtained through either self-insurance or an insurance provider.

Understand Workers' Compensation Benefits

The types of benefits available under Delaware workers' compensation include the following:

• Medical benefits: Payment for all necessary medical, surgical, hospital, and related medical fees
• Temporary total disability benefits: Total disability benefits are payable on the fourth last work day following an injury. No waiting period applies if the disability extends to seven days. The benefits paid are approximately 66% of the gross weekly wage
• Permanent impairment benefits: Subject to loss type, benefits are paid for permanent loss of use of extremities such as hands or legs, or visual or auditory ability. Benefits are also paid for permanent damage to the spine, heart, and other organs or body parts
• Disfigurement benefits: Scheduled payment is provided for scars and permanent disfigurement
• Death benefits: Benefits are available for dependents of individuals who die from workplace injuries or illnesses. Funeral benefits up to a maximum of $3,500 are also provided

To protect a workers' compensation claim, injured or ill workers must do the following:

• Immediately notify the employer in writing of injury or diagnosis of illness, and request medical services
• Provide prompt notice to the employer of any claim for disability beyond a third lost day of work
